Our new study, Forecasting Artificial Intelligence in Health Care: A Systematic International Patent Analysis has just been published in the Journal of Medical Internet Research AI. The study provides an in-depth analysis of healthcare AI patents over the past decade. It includes more than 10,000 from 2012 to 2020. This exploration sheds light on the current trends in AI, where it is headed in various medical specialties and what the future of AI and Machine Learning in healthcare could be.
In 2019-2020, we began our journey into the worlds of healthcare AI regulation and innovation with this study that was published in Nature Digital Medicine. The FDA has been approving AI devices for many years but they have not initially differentiated them as a distinct category. We decided to sort through all of these approvals in order to identify the ones that were AI-based. We created an open-access data base, which we then shared with the FDA. Imagine our joy when, one year later, FDA published its own database citing us as the source!
We also created an infographic to illustrate our work: “The Current Status of FDA-Approved AI-Based Medical Devices.” This has, to our great pleasure, been downloaded millions and updated regularly since that time. This is the latest version:
New database
Our curiosity did not stop there. In our latest study, we focused primarily on AI-based health care patents. We used data from five of the most active patent offices, as there is a unified global database. Over the last 10 years, we identified more than 10,000 patents of this type.
This was not only a strategic undertaking, but it also provided regulators with an improved picture of the future technologies and landscape that they will have to manage.
We used the Espacenet Database, which contains patents from China National Intellectual Property Administration (CNIPA), European Patent Office (EPO), Japan Patent Office (JPO), Korean Intellectual Property Office (KIO), and United States Patent and Trademark Office.

- China National Intellectual Property Administration accounted for 66.9% of the patents (7,332) with an impressive 66.9% (7.332).
- The United States Patent and Trademark Office contributed 25,2% (2,768 Patents).
- The Korean Intellectual Property Office 4,7% (513 Patents)
- The European Patent Office 1,7% (191 Patents)
- The Japan Patent Office has 163 patents, or 1.5% of the total.
The number of patents published increased by an astonishing double every year from 2015 to 2021. This surge was largely attributed to five international companies:
- Ping An Medical and Healthcare Management Co Ltd topped the list with 568 (5.2%) patents.
- Siemens Healthineers is second with 273 (2,5%) patents.
- IBM Corp. with 226 (2%) patents
- Philips Healthcare has 150 patents (1.4%).
- Shanghai United Imaging Healthcare Co Ltd has 144 (1,3%) patents.
You can predict the areas that will require regulatory attention
This data allows us to draw several conclusions. It is possible to predict what areas need regulatory attention. This is because patents follow market-ready devices/products in a predictable order. Radiology and Oncology were the areas with the most patents. These will be the ones to see new technologies entering clinical practice within a few short years.
It is important to keep an eye on China, as it is clearly at the forefront of innovation.
